Overview
Codity Corporation, an Ontario corporation (“Codity” or “we”), provides design and development solutions that connect companies with expert design teams.
Please read these Terms of Service and our Privacy Policy before using our Services. These Terms set out the conditions that apply when you use our Services.
Acceptance of Terms
Codity provides its Service through its website located at https://Codity.works/ (the “Site”) or in other ways as determined by us in our sole discretion, subject to these Terms of Service. By using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree with these Terms, you must not use the Service.
Codity may modify these Terms from time to time by providing thirty (30) days’ prior notice via email or by posting a notice on the Site. Your continued use of the Service after such changes take effect constitutes acceptance of the revised Terms. If you disagree with any changes, your only remedy is to stop using the Service.
Description of Services
The “Service(s)” include any and all design and development services provided by Codity, including, but not limited to:
The Site;
Codity’s software-as-a-service platform for engaging software designers and developers;
Codity’s platform for managing software design and development projects; and
Any software, data, reports, and content made available through the above
General Conditions / Access and Use of the Service
You may access and use the Service only for lawful purposes. All rights, title, and interest in the Service remain with Codity. You shall not:
(a) sublicense, resell, rent, lease, transfer, assign, or otherwise commercially exploit the Service;
(b) use the Service in violation of applicable privacy, intellectual property, or export control laws;
(c) modify, adapt, hack, or attempt to gain unauthorized access to the Service or related networks.
Codity reserves the right to access your data to provide technical support. By submitting Your Content, you grant Codity a non-exclusive, royalty-free license to use and display Your Content solely for the purpose of providing the Service
Privacy Policy and Data Protection
Codity collects and processes personal information in accordance with its Privacy Policy (https://Codity.works/privacy-policy) and applicable Canadian privacy laws, including the Personal Information Protection and Electronic Documents Act (PIPEDA).
Representations and Warranties
You represent and warrant that:
You have the authority to enter into these Terms;
You own or have the necessary rights to Your Content;
Your use of the Service does not violate any third-party rights, including intellectual property rights;
You are at least eighteen (18) years old.
Termination
Codity may suspend or terminate your access to the Service for any breach of these Terms. We will provide notice where reasonable under Ontario consumer protection laws.
Disclaimer of Warranties
The Service is provided “as is” and “as available” without warranties of any kind, including but not limited to merchantability, fitness for a particular purpose, and non-infringement. Codity does not guarantee that the Service will be uninterrupted, error-free, or secure.
Limitation of Liability
To the maximum extent permitted by Ontario law, Codity shall not be liable for indirect, incidental, or consequential damages arising from your use of the Service. In jurisdictions where limitations on liability are restricted, Codity’s liability will be limited to the extent permitted by law.
